Terms and Conditions

Service Agreement

By engaging Diaz Quality Landscaping LLC or its subcontractors ("Diaz Quality Landscaping"), the customer authorizes all approved work to be performed. This agreement becomes effective on the date services are requested or the contract is signed. Services will continue to be provided by Diaz Quality Landscaping until terminated by either party according to the terms outlined below.

Contract Duration and Cancellation

Diaz Quality Landscaping LLC reserves the right to terminate this agreement at any time with proper notification. Customers may cancel this contract at any time by providing written notice to Diaz Quality Landscaping at least 48 hours in advance. Notice must be provided by phone at (734) 239-2914 or via email to confirm the cancellation request.

Pricing and Payment Terms

Diaz Quality Landscaping LLC reserves the right to adjust service pricing annually or as needed. In the event of pricing changes, customers will receive a minimum of 30 days' written notice. If no response is received from the customer during this 30-day notification period, the customer will be subject to the updated pricing structure.

Payment is due upon completion of services unless other arrangements have been made in writing. Late payments may be subject to additional fees as outlined in your service agreement.

Liability and Property Damage

Diaz Quality Landscaping LLC is not responsible for damage to underground utilities, plumbing, or wiring of any kind that are not properly marked or disclosed prior to service. We are also not liable for sprinkler heads or irrigation systems damaged due to improper installation, malfunction, or inadequate marking.

Any property damage that occurs while Diaz Quality Landscaping crews are on site must be reported to our office within 48 hours by calling (734) 239-2914. All reported damages will be assessed to determine the extent of our responsibility, and appropriate repairs will be made or reimbursement will be provided. Damages not reported within 48 hours or repairs made before assessment may result in denial of reimbursement.

Service Scheduling and Modifications

If a customer wishes to skip a scheduled service, a minimum of 48 hours' notice is required. Please contact us at (734) 239-2914 to modify your service schedule.

Irrigation systems and sprinklers must not be running on scheduled service days. Service days are subject to change due to inclement weather, holidays, or other unforeseen circumstances. Route schedules and service days are determined by geographic location and may be adjusted as needed to ensure efficient service delivery.

Additional Services and Specialty Work

Specialized services including but not limited to irrigation repair, fertilization, aeration, and tree and shrub care may be performed by qualified subcontractors working with Diaz Quality Landscaping LLC. Customers will be billed by Diaz Quality Landscaping for these services, and any questions or concerns regarding this work should be directed to Diaz Quality Landscaping at (734) 239-2914.

Irrigation and sprinkler repair services will be billed separately based on labor and materials used. Estimates will be provided before work begins when possible.

Fertilization and Treatment Services

Customers selecting individual fertilization applications rather than a comprehensive program will be charged the per-application rate for each service. This rate may be higher than the program rate.

Tree and shrub treatment services apply to ornamental shrubs, decorative trees, and trees 40 feet in height and under. Natural wooded areas, forest sections, and trees exceeding 40 feet are not included in standard treatment pricing and require separate quotes.

For any chemical applications, customers will receive notification including the applicator's name, target pest or purpose, active ingredients used, date and time of application, and any necessary precautionary information. By accepting our services, you agree to receive these notifications electronically within 48 hours of each application.

Customer Responsibilities

Customers are responsible for:

  • Ensuring pets are secured and away from work areas during scheduled service times
  • Marking or disclosing the location of underground utilities, irrigation lines, and other hidden obstacles
  • Providing clear access to all areas requiring service
  • Turning off irrigation systems on scheduled service days
  • Notifying Diaz Quality Landscaping of any changes to property conditions that may affect service delivery
  • Providing timely payment for services rendered

Weather and Service Interruptions

Service schedules may be affected by inclement weather, including heavy rain, extreme temperatures, or dangerous conditions. Diaz Quality Landscaping LLC will make every effort to notify customers of schedule changes and will reschedule services as quickly as conditions permit.

Warranty and Guarantees

Diaz Quality Landscaping LLC stands behind the quality of our work. If you are not satisfied with any service provided, please contact us within 7 days at (734) 239-2914 so we can address your concerns. Specific warranty terms for installation work, such as landscaping or hardscaping projects, will be provided in writing at the time of service.

Limitation of Liability

Diaz Quality Landscaping LLC's liability is limited to the amount paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages arising from our services. This includes but is not limited to loss of use of property, lost profits, or damage to items not directly related to the services provided.

Dispute Resolution

In the event of any dispute arising from these terms or the services provided, both parties agree to first attempt to resolve the matter through direct communication. If resolution cannot be reached, the parties may pursue mediation before seeking legal remedies.

Modifications to Terms

Diaz Quality Landscaping LLC reserves the right to modify these terms and conditions at any time. Customers will be notified of significant changes in writing. Continued use of our services after notification constitutes acceptance of the modified terms.
